Availability of external funding influences the viability and structure of scientific fields. In the 1980s, structural changes in the manner in which external funds became available started to have an impact on materials science and engineering in the United States. These changes colluded with the search for a disciplinary identity of this research field inside the university. The solutions that arose were intended to find a mediating structure between external demands and resources and disciplinary orientation. Interviews with seventeen scientists in (...) seven universities revealed the impact in local university settings. The rise of research centers as new organizational units in universities can be linked to two periods. In the 1960s, expensive instruments stimulated unit formation; in the 1980s, the increase in application-related funding forced new administrative ways. It is shown that organizational changes also have an impact on disciplinary identity as witnessed by a strong increase in interdisciplinary materials Ph.D.s awarded. (shrink)

Legal information retrieval is in need of the provision of legal knowledge for the improvement of search strategies. For this purpose, the LOIS project is concerned with the construction of a multilingual WordNet for cross-lingual information retrieval in the legal domain. In this article, we set out how a hybrid approach, featuring lexically and legally grounded conceptual representations, can fit the cross-lingual information retrieval needs of both legal professionals and laymen.

Recent history makes clear that the quantum leaps being made in technology are the leading edge of a groundswell of paradigm shifts taking place in science, politics, economics, social institutions, and the expression of cultural values. Kant a fait le premier pas pour émanciper la logique du primat de la forme judicative (p. 67). Mais ni son contextualisme temporel, qui rapporte tout ce qui est su à la forme du temps (p. 345), ni les efforts de son continuateur Cohen pour fonder l’idéalisme critique sur un dépassement du psychologisme n’ont réussi à réconcilier la raison avec la réalité ou à rétablir son unité (p. 205). Peter Fitzpatrick’s writings prove once and for all that it is possible for a law professor to write in beautiful English. His work also proves once and for all that the dominating tradition of Anglo-American legal philosophy and of law teaching has been barking up the wrong tree: namely, that the philosopher and professional law teachers can understand justice as nested in empty forms, better known as rules, doctrines, principles, policies, and other standards. The more rigorous our analysis or decomposition (...) of the forms, we have believed, the more closely do we access the identity of laws. Justice has been assumed to be a matter of intellectually accessing such analysed forms. Fitzpatrick’s articles and books embody an implicit critique of the analytic view of law and of justice. My entry point into this critique is his preoccupation with Jacques Derrida’s theory of laws as universals and with Derrida’s theory of justice as an inaccessible immediacy or presence in context-specific or concrete experienced events. Each event is experienced in an official’s decision. Such a decision represents what Derrida, Fitzpatrick, and Hegel call ‘individuality’. -/- Derrida’s theory of law presents a conundrum. Derrida misses the possibility that law may exist by virtue of its content rather than its form. Derrida misses this possibility because, heavily influenced by Kant (in Derrida’s theory of law), Derrida associates law with universals. This is so because Kant (and Derrida) are preoccupied with the identity of what counts as a law (lois) rather than with a law’s legitimacy. A universal cannot exist unless it is legitimate, and it is legitimate, I claim, by virtue of its content. In his association of law with universals, Derrida presupposes that legal knowledge exists with reference to a territorial-like boundary. The forms are represented or signified by signs (signifiers) within a boundary of the ultimate form (the state, the nation, or humanity). This ultimate form as a universal, like the discrete rules or forms, lacks socially contingent content. A boundary separates knowable universals from the unknowable world on the exteriority of the boundary. The unknowable world is constituted by concrete events experienced in context-specific circumstances. In his legal theory Derrida hones in upon the decision as the experienced event. In a decision, one is present or immediate with the event. Derrida considers such immediacy as justice. The immediacy, however, can only be represented as a sign (sometimes called a signifier). The sign, in turn, represents an empty signified or form, according to Derrida. Because the immediacy remains a representation rather than a presentation of the experienced event, laws as universals cannot be just. The rupture between the inaccessible immediacy of a decision on the one hand and the represented empty forms on the other is critical to Derrida’s theory of law. -/- I claim that this rupture permeates Derrida’s writings about law because Derrida possesses a territorial-like sense of legal knowledge. I shall argue to this effect as follows. In the first section I shall explain the importance of Fitzpatrick’s exposure of the vacuity of the foundation of the system or structure of universals. In the second section I shall flesh out two elements of Derrida’s legal theory: law as form and the ipseity or concrete event that the form excludes from law. This takes me to the third section, where I shall elaborate how Derrida’s legal theory presupposes knowledge as territorial. I shall argue in the final section that this very sense of territorial knowledge prevents justice from accessing law and law from accessing justice. I conclude with the hint of a very different sense of law, one that draws from experiential knowledge in contradistinction to territorial knowledge. (shrink)

A growing interest in and concern about the adequacy and fairness of modern peer-review practices in publication and funding are apparent across a wide range of scientific disciplines. Although questions about reliability, accountability, reviewer bias, and competence have been raised, there has been very little direct research on these variables.The present investigation was an attempt to study the peer-review process directly, in the natural setting of actual journal referee evaluations of submitted manuscripts. As test materials we selected 12 already published (...) research articles by investigators from prestigious and highly productive American psychology departments, one article from each of 12 highly regarded and widely read American psychology journals with high rejection rates (80%) and nonblind refereeing practices.With fictitious names and institutions substituted for the original ones (e.g., Tri-Valley Center for Human Potential), the altered manuscripts were formally resubmitted to the journals that had originally refereed and published them 18 to 32 months earlier. Of the sample of 38 editors and reviewers, only three (8%) detected the resubmissions. This result allowed nine of the 12 articles to continue through the review process to receive an actual evaluation: eight of the nine were rejected. Sixteen of the 18 referees (89%) recommended against publication and the editors concurred. The grounds for rejection were in many cases described as “serious methodological flaws.” A number of possible interpretations of these data are reviewed and evaluated. (shrink)

How should we respond to extremist views that we know are false? This paper proposes that we should be intellectually humble, but not open-minded. We should own our intellectual limitations, but be unwilling to revise our beliefs in the falsity of the extremist views. The opening section makes a case for distinguishing the concept of intellectual humility from the concept of open-mindedness, arguing that open-mindedness requires both a willingness to revise extant beliefs and other-oriented engagement, whereas intellectual humility requires neither. Building on virtue-consequentialism, the second section makes a start on arguing that intellectually virtuous people of a particular sort—people with ‘effects-virtues’—would be intellectually humble, but not open-minded, in responding to extremist views they knew were false. To better navigate social interactions, we routinely (consciously or unconsciously) categorize people based on their distinctive features. One important way we do this is by ascribing political orientations to them. For example, based on certain behavioral cues, we might perceive someone as politically liberal, progressive, conservative, libertarian, Marxist, anarchist, or fascist. Although such ascriptions may appear to be mere descriptions, I argue that they can have deeper, regulative effects on their targets, potentially politicizing and polarizing them in ways that remain (...) underexplored in research on political polarization. To capture this dynamic, I introduce the notion of ‘politicizing mindshaping,’ distinguish it from other types of politicization, and review evidence suggesting that politicizing mindshaping is likely common. Finally, I contend that the pernicious effects of politicizing mindshaping may currently be significantly underestimated. This is because, unlike in many other cases of social labeling, negativity in political labeling is, to some extent, widely tolerated – even encouraged – and largely unconstrained by social norms in democratic countries. The following is a review of three recent critical approaches in medieval literary history: 1) of “New Philology”/“Body-Philology” and its discussion of the mediality particular to older texts 2) of concepts of the relationship between literature and society derived from New French Historiography and New Historicism 3) of the specific orientation of feminist and gender research in medieval studies.

While the current philosophical debate surrounding Hegel’s aesthetics focuses heavily on the philosopher’s controversial ‘end of art’ thesis, its participants rarely give attention to Hegel’s ideas on the nature of beauty and its relation to art. This study seeks to remedy this oversight by placing Hegel’s views on beauty front and center. Peters asks us to rethink the common assumption that Hegelian beauty is exclusive to art and argues that for Hegel beauty, like art, is subject to historical development. (...) Her careful analysis of Hegel’s notion of beauty not only has crucial implications for our understanding of the ‘end of art’ and Hegel’s aesthetics in general, but also sheds light on other fields of Hegel’s philosophy, in particular his anthropology and aspects of his ethical thought. It is unknown to what extent medical researchers generalize study findings beyond their samples when their sample size, sample diversity, or knowledge of conditions that support external validity do not warrant it. It is also unknown to what extent medical researchers describe their results with precise quantifications or unquantified generalizations, i.e., generics, that can obscure variations between individuals. We therefore systematically reviewed all prospective studies (n = 533) published in the top four highest ranking medical journals, Lancet, New England Journal (...) of Medicine (NEJM), Journal of the American Medical Association (JAMA), and the British Medical Journal (BMJ), from January 2022 to May 2023. We additionally reviewed all NEJM Journal Watch clinical research summaries (n = 143) published during the same time. Of all research articles reporting prospective studies, 52.5% included generalizations beyond specific national study populations, with the numbers of articles with generics varying significantly between journals (JAMA = 12%; Lancet = 77%) (p < 0.001, V = 0.48). There was no evidence that articles containing broader generalizations or generics were correlated with larger or more nationally diverse samples. Moreover, only 10.2% of articles with generalizations beyond specific national populations reported external validity strengthening factors that could potentially support such extrapolations. There was no evidence that original research articles and NEJM Journal Watch summaries intended for practitioners differed in their use of broad generalizations, including generics. Finally, from the journal with the highest citation impact, articles containing broader conclusions were correlated with more citations. Since there was no evidence that studies with generalizations beyond specific national study populations or with generics were associated with larger, more nationally diverse samples, or with reports of population similarity that may permit extensions of conclusions, our findings suggest that the generalizations in many articles were insufficiently supported. Caution against overly broad generalizations in medical research is warranted. (shrink)

For synergistic interactions between humans and artificial intelligence (AI) systems, AI outputs often need to be explainable to people. Explainable AI (XAI) systems are commonly tested in human user studies. However, whether XAI researchers consider potential cultural differences in human explanatory needs remains unexplored. We highlight psychological research that found significant differences in human explanations between many people from Western, commonly individualist countries and people from non-Western, often collectivist countries. We argue that XAI research currently overlooks these variations and that (...) many popular XAI designs implicitly and problematically assume that Western explanatory needs are shared cross-culturally. Additionally, we systematically reviewed over 200 XAI user studies and found that most studies did not consider relevant cultural variations, sampled only Western populations, but drew conclusions about human-XAI interactions more generally. We also analyzed over 30 literature reviews of XAI studies. Most reviews did not mention cultural differences in explanatory needs or flag overly broad cross-cultural extrapolations of XAI user study results. Combined, our analyses provide evidence of a cultural bias toward Western populations in XAI research, highlighting an important knowledge gap regarding how culturally diverse users may respond to widely used XAI systems that future work can and should address. It has been argued that our currently most satisfactory social epistemology of science can’t account for science that is based on artificial intelligence (AI) because this social epistemology requires trust between scientists that can take full responsibility for the research tools they use, and scientists can’t take full responsibility for the AI tools they use since these systems are epistemically opaque. I think this argument overlooks that much AI-based science can be done without opaque models, and that agents can take (...) full responsibility for the systems they use even if these systems are opaque. Requiring that an agent fully understand how a system works is an untenably strong condition for that agent to take full responsibility for the system and risks absolving AI developers from responsibility for their products. AI-based science need not create trust-related social epistemological problems if we keep in mind that what makes both individual scientists and their use of AI systems trustworthy isn’t full transparency of the internal processing but their adherence to social and institutional norms that ensure that scientific claims can be trusted. A large part of the current debate among virtue ethicists focuses on the role played by phronesis, or wise practical reasoning, in virtuous action. The paradigmatic case of an action expressing phronesis is one where an agent explicitly reflects and deliberates on all practical options in a given situation and eventually makes a wise choice. Habitual actions, by contrast, are typically performed automatically, that is, in the absence of preceding deliberation. Thus they would seem to fall outside of the primary (...) focus of the current virtue ethical debate. By contrast, Bill Pollard has recently suggested that all properly virtuous actions must be performed habitually and therefore automatically, i.e. in the absence of moral deliberation. In this paper, Pollard’s suggestion is interpreted as the thesis that habitual automaticity is constitutive of virtue or moral excellence. By constructing an argument in favor of it and discussing several objections, the paper ultimately seeks to defend a qualified version of this thesis. (shrink)

Scientists may sometimes generalize from their samples to broader populations when they have not yet sufficiently supported this generalization. Do such hasty generalizations also occur in experimental philosophy? To check, we analyzed 171 experimental philosophy studies published between 2017 and 2023. We found that most studies tested only Western populations but generalized beyond them without justification. There was also no evidence that studies with broader conclusions had larger, more diverse samples, but they nonetheless had higher citation impact. This paper argues that the bias in Western philosophy is tied to its humanist ideology that pictures itself as central to the natural history of humanity and is historically linked to the emergence of humanism as pedagogy.

Some artificial intelligence systems can display algorithmic bias, i.e. they may produce outputs that unfairly discriminate against people based on their social identity. Much research on this topic focuses on algorithmic bias that disadvantages people based on their gender or racial identity. The related ethical problems are significant and well known. Algorithmic bias against other aspects of people’s social identity, for instance, their political orientation, remains largely unexplored. This paper argues that algorithmic bias against people’s political orientation can arise in (...) some of the same ways in which algorithmic gender and racial biases emerge. However, it differs importantly from them because there are strong social norms against gender and racial biases. This does not hold to the same extent for political biases. Political biases can thus more powerfully influence people, which increases the chances that these biases become embedded in algorithms and makes algorithmic political biases harder to detect and eradicate than gender and racial biases even though they all can produce similar harm. Since some algorithms can now also easily identify people’s political orientations against their will, these problems are exacerbated. Algorithmic political bias thus raises substantial and distinctive risks that the AI community should be aware of and examine. (shrink)

The notion that a free society should allow Klansmen, neo-Nazis, sundry extremists, and pornographers to spread their doctrines as freely as everyone else has come increasingly under fire. At the same time, in the wake of 9/11, the Right and the Left continue to wage war over the utility of an absolute vision of free speech in a (...) time of increased national security. _Courting the Abyss_ revisits the tangled history of free speech, finding resolutions to these debates hidden at the very roots of the liberal tradition. A mesmerizing account of the role of public communication in the Anglo-American world, _Courting the Abyss_ shows that liberty's earliest advocates recognized its fraternal relationship with wickedness and evil. While we understand freedom of expression to mean "anything goes," John Durham Peters asks why its advocates so often celebrate a sojourn in hell and the overcoming of suffering. He directs us to such well-known sources as the prose and poetry of John Milton and the political and philosophical theory of John Locke, Adam Smith, John Stuart Mill, and Oliver Wendell Holmes Jr., as well as lesser-known sources such as the theology of Paul of Tarsus. In various ways they all, he shows, envisioned an attitude of self-mastery or self-transcendence as a response to the inevitable dangers of free speech, a troubled legacy that continues to inform ruling norms about knowledge, ethical responsibility, and democracy today. A world of gigabytes, undiminished religious passion, and relentless scientific discovery calls for a fresh account of liberty that recognizes its risk and its splendor. Instead of celebrating noxious doctrine as proof of society's robustness, _Courting the Abyss_ invites us to rethink public communication today by looking more deeply into the unfathomable mystery of liberty and evil.
